Since the beginning of ââ¬Å"timeâ⬠man has questioned their existence and what has caused their creation. Through my readings I have read numerous theories, ideas, and beliefs. Some drastically contrast, and others simply elaborate on previous hypotheses. These projected explanations of our existence, can cause great confusion and uncertainty. This confusion, I have found through my readings, is predominantly found in the Western philosophies. We either question or find reasons to believe in the very existence of a divine creator or even existence of our own being as well. This uncertainty within the Western culture is what led me to choose this question. After reading about the Eastern religious traditions I was very attracted to the fact that the idea of God is never questioned as greatly opposed as it is in the Western culture. This in itself is where I think a violent and unjust world evolved. Without the belief of a creator, life can seem depressing, and could possibly cause one to not care about their life which as a result they do not care about others lives. A second quality that attracted me greatly was that they do not practice a threat of eternal damnation. Our so-called hell that we have thought to believe is basically torture for not following the life that some say is the word of God. I have always been very curious as to what happens to those of us on earth that were uneducated about religion or those that died young. The Buddhists believe in Karma. I have always based my own actions around a Karma based aim unknowingly that this was a Buddhist belief. With these two key beliefs I do in fact find the eastern culture appealing in these areas. Although I do not plan on converting any time soon I can see where a Westerner could be attracted to the Eastern culture, when before reading this chapter I hypothesized that Eastern cultures were ancient and obsolete.... Berties initial contact Bertieââ¬â¢s initial contact, Freddy grabbing his elbow to gain his attention and Bertie pushing him away could all arguably constitute a battery. A battery is the direct infliction of unlawful force on another person without lawful justification. In order for them to be considered a battery they must satisfy the requirements. There must be an application of force, the force must be direct and immediate and the contact must be unlawful. The law prohibits all deliberate touching as ââ¬Ëit has long been established that any touching of another however slight, may amount to a batteryââ¬â¢. There are however some exceptions. Exceptions are made for minor everyday touching, Lord Goff in Collins v Wilcock [1984] 1 WLR 1172 states that ââ¬Ëboarder exceptions has been created to allow for the exigencies of everyday lifeââ¬â¢. (Harvey, Barbara & Marston, John (6th Edition) Cases and Commentary on Tort, Oxford University Press p351) Bertieââ¬â¢s initi al contact could be arguably ââ¬Ënot actionableââ¬â¢ (Harvey & Marston, Tort) because such slight jostling is ââ¬Ëimpliedly consented by all who move in society and expose themselves to the risk of bodily contactââ¬â¢ (Collins v Wilcock). He does not therefore satisfy the first requirement. The touching is perhaps negligent but not intentional. In Cole v Turner it was said that if two or more people meet in a passage and ââ¬Ëwithout any violence or design of harm the one touches the other gently it will be no batteryââ¬â¢ (Cole v Turner) and the aforementioned dicta highlights that a minor touch is ââ¬Ëwidely accepted as part and parcel of everyday lifeââ¬â¢. Freddie would therefore on this basis not be liable for a battery. Freddy intentionally grabbing Peters elbow to attract his attention similarly falls into that category. There is an application of force and it was direct, immediate and intentional, however it would not be considered unlawful. There is a clear distinction between an unlawful battery and touching to draw someoneââ¬â¢s attention. The circumstances are clear that the purpose was to gain Bertieââ¬â¢s attention. Lord Goff in Collins v Wilcock opined that ââ¬Ëalong such forms of conduct, long held to be acceptable, is touching a person for the purpose of engaging his attentionââ¬â¢. It is therefore also likely to be construed also as minor touching. The touching would have to be ââ¬Ëunjustified for Freddy to be liable therefore Freddyââ¬â¢s would not be liable for battery. However Bertie pushing Freddy away could be considered a battery. In Wilson v Pringle [1986] 2 All ER 440 the court of appeal stated the essence of a battery you required a ââ¬Ëhostile intentional touchingââ¬â¢. However Lord Goff suggested that ââ¬Ëqualification is difficult to reconcile with the principle that any touching of anotherââ¬â¢s body is, in the absence of lawful excuse, capable of amounting to a batteryââ¬â¢ . This discounted the need for and ââ¬Ëhostileââ¬â¢ act, and this was confirmed in Collins v Wilcock as the touching of the defendant was considered a battery as there was not a lawful arrest. There was no evidence of hostility in Collins v Wilcock, the requirement was therefore that the touching is merely unlawful. The mental element is also apparent. Lord Denning in Letang v Cooper [1964] 2 All ER 929 opined that ââ¬Ëif one man intentionally applies force directly to another, the claimant has a cause of action in assault and batteryââ¬â¢ (Harvey & Marston, Tort). There can be no doubts that there is an application of force, Bertieââ¬â¢s actions are intentional. The force is direct and immediate and the contact is not one of those excused as everyday jostling. Bertieââ¬â¢s actions will therefore be considered unlawful and therefore they are liable for a battery.

Appiah identifies globalization as an event each individual in the world identifies with. In this regard, he further identifies that the role of globalization is to make the one solid unit where people eliminated the divisions between them and embraced each other as one common people despite their race, religion, and ethnic affiliations. In addition, this commonness in people, as promoted by globalization, should exist regardless of different heritages. The roles of religion while Appiah carried out his analysis is that, religion enabled individuals acquire a global perspective (Livingston). In this regard, a global perspective amongst individuals enabled them to view the world as one homogenous group regardless of the different cultures and religions different people and individuals practiced. Appiahââ¬â¢s approach is not different from in regards to homogeneity of people through globalization. My approach to globalization is that, regardless of the different religions practiced in the word, people are one homogenous group since the role of religion is to enable individuals view others as one homogenous group. However, Appiah identifies peopleââ¬â¢s fear that the magnitude of globalization in the world posed a challenge whereby western civilization could greatly affect cultural diversity. Nevertheless, he analyses the situation and puts it that the right approach involves taking individuals as the appropriate object of moral apprehension instead of a nation or a particular plan. In this regard, religion plays a role in Appiahââ¬â¢s analysis in that, religions identifies each person as independent of a group regardless of what binds the groups together in this case religion being the common link. In addition, judgment will be passed to a person on an individual capacity (Livingston). This is true of the role of religion in that, an individual is independent of the religion, or creed they practiced. In addition, religion notes that we are humans. In ef fect, we think and reason as individuals and not as societies or as collectives on what is morally right or wrong. This approach is similar to my approach of life that there is nothing like collective thinking.
